Recently, the Chinese Trademark Office (CTMO) rendered a decision holding that the opposed mark of MARK ZUCKERBERG & MARK ZUCKERBER in Chinese has infringed upon the name right of the founder and Chief Executive Officer of the world-famous social network website, represented by Beijing East IP Ltd..
The CTMO holds that the opponent is the founder and Chief Executive Officer of a world-famous social network website. According to the custom of English names, the middle name is usually omitted, thus, “MARK ZUCKERBERG” usually indicates the opponent and “MARK ZUCKERBERG in Chinese” is his conventional Chinese transliteration. According to Article 31 of Chinese Trademark Law, the opposed mark shall not obtain registration.
