Mr. Jason Wang, partner at Beijing East IP Law Firm and Trademark Law Committee member at Beijing Bar Association, has published the article Starting Date Calculation for Three-Year Non-Use Cancellation against Registered Marks on China Trademark magazine Issue 2, 2013.
This article points out the frequent misunderstandings on the date where a cancellation may be filed based on the non-use of a registered mark for consecutive three years, by introducing the current practice of Chinese Trademark Office (CTMO), analyzing the logic and reasoning behind the practice in China, as well as putting forward the recommendations to avoid mistakes for the trademark attorneys. Specifically, two situations deserves special attention: (1) the trademark registrations after going through the opposition before the CTMO, opposition appeal before the Trademark Review and Adjudication Board (TRAB), and/or the appeals before the courts; and (2) the International trademark registrations designating the territory of China via Madrid Agreement or Madrid Protocol.
This is the tenth article Mr. Wang has published on China Trademark magazine since 2006. China Trademark magazine is hosted by China Trademark Association under supervision of State Administration for Industry and Commerce (SAIC) which also oversees the CTMO and the TRAB.
