It has always been a huge challenge for oversea entities, in particular for US entities, to submit procedural documents in line with the Court’s requirement to successfully docket administrative cases in China. In an effort to assist the client to docket the cases, we took the initiative in searching and locating official documents at multiple platforms and via various channels that would meet the Court’s stringent requirement for signatory authority, and we kept close and constant contact with both the client and the Court regarding the admissibility of the documents and language therein. Persistent hard-working yielded positive results – we successfully docketed a series of cases before the Court and won favorable judgments thereafter, securing trademark registrations in core classes for the client.

But we never stop at particular success and we always adopt the forward-looking attitude in assisting clients to deal with trademark matters. In order to help the client avoid future issues with case docketing, we continually exchanged with the client regarding the amendment and restatement of its entity certificate and rendered our comments based on our experience and expertise on the inclusion of certain articles and the expression of particular language of the signatory authority. Recently, we have successfully docketed cases before the Court using the Amended and Restated Certificate of Incorporation.
